Legal Notice

Article 1 – General provisions – owner's contact details

These terms apply to the use of all websites (including mobile sites), including their elements and applications, created or owned by the entity whose full contact details appear on the "Contact" page.

The term "user" refers to any person accessing the Sites (User).

By using the Sites, the User fully and unconditionally accepts the Terms applicable to them and undertakes to comply with them.

If the User refuses the Terms, they must refrain from using the Sites and/or Services. In the event of non-compliance with the Terms, the Company reserves the right to refuse access to the Sites, without prejudice to its right to claim compensation from any third party for any direct or indirect damage that may result from such non-compliance.

The Company reserves the right to partially or fully amend the Terms of use at any time, without prior notice.

Users are therefore advised to check the Terms of use regularly to stay informed of the most recent version.

Article 2 – Use of the Sites

Use of the Sites is, in principle, free of charge. To use certain Sites, the User must register, provide certain data, and/or create an access code and/or password.

If the User refuses to do so, use of the relevant parts of the Sites will not be possible.

If certain Sites are used on a paid basis, the User will be informed beforehand, along with the applicable terms, prices, and payment method.

The Company grants the User of the Sites a non-exclusive, non-transferable licence, for an indefinite period, allowing them to download the content of the Sites for the sole purpose of displaying it on a single computer.

This licence is nonetheless revocable at any time, without justification.

The User may also print a copy of the Sites' content for personal use, without making any modification to the content.

The Sites may only be used for personal and private purposes by individuals, and for strictly internal purposes by professionals.

Consequently, any use of the Sites for commercial purposes is strictly prohibited. Users undertake not to perform any act likely to damage the Sites or disrupt their proper functioning.

In the event of abuse or improper use, the Company reserves the right to suspend and/or terminate the User's access to the Sites without formal notice or warning.

Article 3 – Copyright and database producer's rights

All copyrights, trademarks, patents, intellectual property rights, and other proprietary rights applicable to the Sites belong, at all times, to the Company.

The Sites and/or Services constitute both a work protected by copyright and databases over which the Company holds the copyright and producer's rights.

The texts, layout, drawings, photos, films, graphics, and other elements of the Sites are protected by copyright.

Copying, adapting, modifying, translating, arranging, publicly communicating, renting, or any other form of exploitation of all or part of the Sites, in any form and by any means whatsoever, in particular electronic, mechanical, or other, is strictly prohibited without the Company's prior written authorisation.

Any infringement of these rights is subject to civil or criminal prosecution.

Article 4 – Trademarks and trade names

The names, logos, and other signs used on these Sites (in particular the Company's logos and names) are legally protected trademarks and/or trade names.

Any use of these, or of similar signs, is strictly prohibited without the Company's prior written authorisation.

Article 5 – LiabilityThe Company will make every effort to ensure the proper functioning of the Sites.

Except in the case of intentional misconduct and/or mandatory legal provisions to the contrary, the Company disclaims all liability for any loss or damage (direct, indirect, material, immaterial, etc.) resulting from:

(1) the content of the Sites. The Company does not guarantee the accuracy, adequacy, or completeness of the information on the Sites. The information available on the Sites, in particular regarding products and services offered for sale, may be changed without prior notice. The Company takes the greatest care in creating, updating, and maintaining the site. If a User nonetheless notices inaccurate or outdated information, harmful or unlawful content on the site, or believes that one of their rights (intellectual or other) has been infringed, they are strongly encouraged to report it;

(2) the use made of the Sites;

(3) the security of the Sites. This provision applies in particular to any viruses, computer errors, or fraud;

(4) the accessibility/availability of the Sites. The Company does not guarantee the permanent availability, via all technical means, without error or interruption, of all functions of the Sites, nor the immediate correction of errors or the immediate restoration of interruptions.

The Company also has the right to refuse access to the Sites and additional Services, or to terminate them at any time, without prior notice.

The Company cannot under any circumstances be held liable for services and/or products, or their billing, if these are offered by third parties and accessible via the Sites, even if the Company received compensation for this, or if it handled billing for such services and/or products on behalf of third parties.

Where the Company's liability is engaged, it is limited to the sum of €100.00. The above-mentioned limitations and/or exclusions of the Company's liability apply insofar as they are valid under applicable law.

Article 6 – Privacy – processing of personal data

The Company and the User undertake to comply with the regulations in force applicable to the processing of personal data, and in particular Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (GDPR).

The Company collects and processes the identification data and contact details it receives from the User and any other relevant contact person. The purposes of this processing are the performance of an agreement, customer and order management, accounting, and direct marketing activities, such as sending promotional or commercial information. The legal bases are the performance of a contract, the User's consent, compliance with legal and regulatory obligations, and/or the Company's legitimate interest.

The above-mentioned personal data will be processed in accordance with the provisions of the General Data Protection Regulation and will only be transmitted, unless the User gives further consent, to processors, recipients, and/or third parties insofar as necessary for the above-mentioned purposes of the processing.

The User is responsible for the accuracy and updating of the personal data they provide to the Company and undertakes to strictly comply with the provisions of the General Data Protection Regulation with regard to any persons whose personal data they have transmitted, as well as any personal data they may receive from their own customers.

Personal data is retained and processed for the period necessary depending on the purposes of the processing and the relationship (contractual or otherwise). User data will, in all cases, be removed from our systems after a period of 7 years, or, in the case of a contract, after 7 years following its termination, except for personal data we are required to keep longer under specific legislation or in the event of ongoing litigation for which the personal data is necessary.

By giving their consent when providing or communicating their personal data, or by voluntarily continuing to browse the Sites, or upon entering into a contract with the Company, the User consents, in addition to the processing defined above, to the collection and use of their personal data as defined below.

The Company collects personally identifiable information (name, address, telephone number, email address, VAT number, total number of visits to the site, number of visitors to each page of the site, domain names of visitors' internet service providers, IP addresses, cookies).

The User agrees that their data may be used and transmitted to third parties for advertising, commercial, or marketing purposes, and consents to receiving information from the Company or its partners at their email address (newsletter, etc.) or by post.

Right of access: the User has the right to ask at any time whether their data has been collected, for how long, and for what purpose.

Right to rectification: the User has the right to request that any inaccurate or incomplete data be corrected or completed at any time, upon simple request.

Right to restriction of processing: the User may request a restriction of the processing of their data. This means that the data in question must be "flagged" in our computer system and can no longer be used for a certain period.

Right to erasure ("right to be forgotten"): subject to the exceptions provided by law, the User has the right to request that their data be erased. If the User wishes to prevent the Company from using their personal data, they need only write to the address listed in Article 1 or on the contact page.

Right to data portability: the User may request that their data be transmitted to them in a "structured, commonly used, and machine-readable format."

Right to lodge a complaint: the User may lodge a complaint with the data protection authority.

The Company undertakes to implement technical and organisational measures to ensure an adequate level of security to protect the confidentiality of data. The Company will notify the client of any personal data breach it becomes aware of.

Article 7 – Hyperlinks

The Site may include links to other websites. As the Company has no control over these sites, it cannot be held liable for making them available. It cannot bear any liability regarding the content, advertisements, products, services, or any other material available on or from these sites. Furthermore, the Company cannot be held liable for any damages or losses, proven or alleged, resulting from or related to the use of, or reliance on, the content, goods, or services available on these sites.

Article 8 – Cookies

A cookie is a small text file saved by a website's server in the browser of your computer or mobile device when you visit that website. The cookie contains a unique code allowing your browser to be recognised during your visit to the website ("session cookie") or during future repeat visits ("persistent cookie"). Cookies may be placed by the server of the website you visit, or by partners with whom that website collaborates. A website's server can only read the cookies it has itself placed; it has no access to any other information on your computer or mobile device. Cookies are stored on your computer or mobile device in your browser's directory. The content of a cookie generally consists of the name of the server that placed the cookie, an expiry date, and a unique encrypted code. Cookies generally ensure easier and faster interaction between the visitor and the website. They also help the visitor navigate between the different parts of the website. Cookies may also be used to make a website's content or advertising more relevant to the visitor, and to adapt the website to the visitor's personal tastes and needs.

Functional cookies are required to allow visits to the Sites and the use of certain parts of them. These cookies allow you, for example, to navigate between the different sections of the websites, complete forms, place orders, view a multilingual website, and update the contents of your cart. Likewise, when you wish to access your personal account, for example in your admin area or another application made available to you (e.g. Extranet, webmail, etc.), cookies are essential to securely verify your identity before granting access to your personal information.

If you refuse these cookies, some sections of the website will not work properly, or may not work at all.

The Sites place a cookie on your computer for statistical analysis and site audience measurement purposes, and to simplify access to the site. This cookie records information about visitors' browsing on the site. It stores information you entered during your visit, namely certain visitor details such as the domain name and host computer from which the visitor is browsing the internet, the Internet Protocol (IP) address of the computer used, the date and time of the visitor's browsing on the Sites, and the URLs from which the visitor arrived at the site.

Article 9 – User contributions

Users may submit content (video, audio, text, photographic material) in certain areas of the Sites (hereinafter "Contributions"). Users grant the Company explicit permission to reproduce these Contributions on the Sites and thereby make them public via the internet, worldwide and without time limitation, without being entitled to any financial compensation or other consideration.

Users are solely and entirely responsible for the content of their Contributions and the consequences of their distribution via the Sites.

Users warrant that they hold all rights and/or authorisations necessary to publish their Contributions on the Sites as described above.

Users indemnify the Company against any complaint, claim, or action by third parties or any regulatory body relating to their Contributions.

The Company does not exercise prior control over Contributions. It nonetheless reserves the right not to publish, or to remove from its Sites, any unlawful Contribution or any Contribution that may reasonably be presumed to infringe the rights of third parties, without prior notice to the User who submitted the content in question.

Article 10 – Jurisdiction and applicable law

Belgian law applies to the Sites, and the courts of the judicial district of the Company's registered office have sole jurisdiction in the event of disputes arising from the use of the Sites.
